Free Software License Agreement

Please read the terms and conditions of this license agreement (“License”) before installing the Easy Website Builder software(“Software”). By installing the Software you accept and agree to the terms of this License. This License constitutes the entire agreement concerning the Software and it supersedes any prior proposal or representation. The term "Software" includes, and these terms and conditions also apply to, any updates modifications, upgrades to the Software that you may receive from time to time.

1. License Grant

This License permits you to use one copy of the Software solely for your personal or business use. You agree that you will not sublicense, assign, transfer, pledge, lease, rent or share your rights under this License except with prior written permission from nGenuity Solutions. You agree that you will not modify, adapt, disassemble, decompile, reverse engineer, translate or otherwise attempt to discover the source code of the Software. You agree not to alter or hide the Easy Website Builder banner logo and link in the webpage footer. nGenuity Solutions may update the syndicated logo link at any time. This logo can be removed by purchasing the paid license.

2. nGenuity Solutions Right

You acknowledge and agree that the Software and Documentation (the "Licensed Products") are proprietary products of nGenuity Solutions under international copyright law and disclosed to you by nGenuity Solutions in confidence. nGenuity Solutions owns and will retain all copyright, trademark, trade secret and other proprietary rights in and to the Licensed Products. In the event that you fail to comply with any terms and/or conditions hereof, this License shall terminate automatically and nGenuity Solutions shall be entitled to all remedies in accordance with applicable law.

3. Disclaimer of Warranties

You expressly acknowledge and agree that use of Easy Website Builder software is at your sole risk and that the entire risk as to satisfactory quality, performance, accuracy and effort is with you. The Easy Website Builder software is provided “as is”, without warranty of any kind, and nGenuity Solutions hereby disclaims all warranties and conditions with respect to Easy Website Builder software, either express, implied or statutory, including, but not limited to, the implied warranties and/or conditions of merchantability, of satisfactory quality, of fitness for a particular purpose, of accuracy, of quiet enjoyment, and non-infringement of third party rights. Should the Easy Website Builder software prove defective, you assume the entire cost of all necessary servicing, repair or correction.

4. Limitation of Liability

To the extent not prohibited by law, in no event shall nGenuity Solutions be liable for personal injury, or any incidental, special, indirect or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruption or any other commercial damages or losses, arising out of or related to your use or inability to use the apple software, however caused, regardless of the theory of liability (contract, tort or otherwise) and even if nGenuity Solutions has been advised of the possibility of such damages. nGenuity Solutions is not liable to you for prosecution arising from use of the Software against law (including, but not limited, selling prohibited products or products acquired as a result of criminal activity exasperating interracial or international antagonism through the online shop; and etc.).
